Fair use still applies, even to trademarked videos
I don't see the problem, you can still challenge it and they simply don't have the money to sue everyone who challenges especially considering they know they'll loose

hell, even the fine brothers's reaction series is better. sure, it's dumb reaction videos, but at least there's some production value in there and it isn't filmed in someone's bedroom
