Streaming music while playing a game is not fair use. You are not a radio broadcaster, you have not licensed music for broadcast. With exception to the videos being false flagged for licensed music (like DOTA 2 and LoL tournaments) or game audio (Like Fallout 3) none of this is legal and Twitch is responsible for it if they don't implement a system like this.
You are treated guilty until proven innocent because that is the law. If Twitch/Youtube/whatever don't take down the video until you can prove it's in error they are liable.
Is it bullstuff? Yes, but it's not Google's fault. This is the law. You don't like it? Get it changed. Make enough noise by writing your senator/rep and getting everyone else you know to. If you make enough noise to outweigh the hundreds of millions of dollars the music industry pours into washington through lobbyists, then maybe it'll get changed.
Otherwise? Nope. This is going to happen to everything.
