Got off the phone with Ubisoft. turns out they already know about this problem. and they are working on a fix which should be available in a few weeks. hopefully. the people who have been affected by the bug. will have their saves back.

Found a glitch where if you go to the highway in Parker square, shoot the citizens in their cars, they won't call the police. Drive down the freeway to the train station underneath, keep firing, get the cops called on you. Let the yellow scanner find you, drive through the fence into the tunnel, wait for the train, jump in, and stay till the timer goes down. You will get 500 cup for doing so, and if you shoot again when the helicopter is out of line of view. It will have the police on you again.
