Hate crimes are a farce. Yes, its assault and they should be prosecuted to the fullest extent of the law - BUT - it is not the state's business on what the attacker thought of the Muslim family's beliefs because its not the state's job to control the thoughts of its people, in this case a guy who hates Muslims and committed a heinous crime against a (probably) innocent family.

In this case it's a guy who intended to kill a man and committed a heinous crime against a (probably) innocent victim.
tl;dr your logic is flawed, there is a precedence already for the law to take into account the attacker's mindset when committing a crime, so claiming that hate crimes are a 'farce' because it's based on what the attacker THINKS is wrong.
