al-Qaida is a independent terrorist organization and it's members come from a variety of countries no country leads them and therefore all countries can persecute them for their criminal acts against there country. It seems as though you feel that if someone from another country goes to a country and commits mass homicide they should be able to leave unharmed.

It's been pulverized so much it no longer exists. So, technically, if we capture one of there terror dudes, if this is taken up to the Federal Court, then we have every right to hold a case and charge him and give a sentence, which is most likely death.

Also, if it were a US citizen who did 9/11, wouldn't that count as Treason against the US?

Yes but, it they weren't US citizens. Related though, a few years ago the first man since WW2 was charged with treason, he was an american born Al Qaeda member living in california and spreading propaganda.
