I'm not understanding how they could possibly be confused.

Pirating games=stealing/buying them illegitimately
Torrenting games=stealing

But, there is a bit of a difference, technically you can torrent legally seeing as you can upload a game strictly to transfer your files to a friend's house for example if you don't have a Flashdrive and it's too big for a CD/DVD.
