Piracy is making an illegal digital copy of; music, game, movies, or something similar, so I don't think so. Might have to give credit though.

If you use it to make money then yes it is illegal.

If you share it privately, you'd be fine.
If you share it publicly, you are at risk of copyright infringement, though this occurs most often with music.
If you sell it publicly, it is piracy.

However, you can sell it only if you request to do so from the creator, publisher or producing company.  They will usually ask for royalties if they approve of it in the first place.  If they do ask, then you must pay out whatever percentage of your earnings to them.  It's best to have that written on paper and signed by the creator/author or some representative on behalf of them.
