That's actually really strange. I've never had that happen before. Have you ever tried approaching Apple Support about it?
My brother's phone/iPod Touch had this situation, and it was because he never set it up with a computer. Never backed it up once. Whereas me and my parent's phones have always been set up on our computers and we back up now and then.
So protip: if you want your device to not get forgeted, set it up on a computer.
