Homebrew games are legal. Downloading full games of real games is illegal, unless you own it. I believe.

I only use my Acekard 2 for Homebrew, since I'm not cheap.
Homebrew is freeware. Nothing illegal about freeware.
Edit: Rip it yourself, somehow.
