Isn't this like pirating? I dont know. Just the sound of roms make me think this is pirating.

The "ben.avi" creepypasta he's talking about is sort of a really, really messed up and edited version of the original Majora's Mask.
So yes, I guess it could be considered pirating, but I'm not really sure what I'd call it.
