A few hours ago, a port of Minecraft to the DS was released by a user known only by "smealum"
Right now, it is only a tech demo, and you can only remove blocks. It is very buggy, but once progress is made, it will be a full-fledged Minecraft homebrew port for DS.

I haven't tried the homebrew, but to run it you'll need a flashcart, or it might work on a emulator.

Minecraft is already a clone of infiniminer.
Notch wrote this himself:

Notch also wrote that he doesn't care if it gets cloned too.
so no problem in that :D
