Guards will attack NPCs which can be killed/knocked out, provided they attack you first, making them the criminal and not you.
At least, that's true of Oblivion, hence why "pcsetinfamy 10000" on a guard makes for fun viewing.

I was going to say that there's no way to get them hostile without console codes, but then I remembered Rage spells.
