Is emulating "LSD Dream Emulator" pirating?

Title says it all. I'd like to know if it would be considered pirating if i emulated LSD, or if the game was free to use like some other old games. My first choice was to buy an actual copy and play it on my backwards compatible PS2, then I found out that LSD copies are somewhat rare and go for around 200 dollars on ebay. The next closest thing I can afford is an emulator and a gamepad.

NOTE: I didn't download it yet, I'm only asking.

I dont really think that its a big deal if the game is like the one you are talking of. Rare games are ok for emulating IMO.

I'm not sure how that works, seeing as how it was put the Playstation Network for purchase and download like a year or so ago.

so if i'd want to play the game without pirating i'd have to go out and buy a ps3? if i'm going to buy a $300 game console and probably a $10 dollar game i might as well go and by an original.
