Depends, if its open source and they making it fall under gnu then he won't be able to sell the game.

it's been out for 5 years and badspot and komp who were both torque employees both think it's a bad idea.

Reality check:  I worked for garage games for a year.  Kompressor was the Torque technologies director for like 5 years.  We both think "upgrading" to Torque3D is a bad idea.

Not to mention how heavily modified off the main engine the game is at this point - I doubt it would be worth the effort to move over everything, even if being open source allows some people to improve what is there.
