In what part of the agreement before installation states no abuse? Or after installation, or in the download or buy now portion of the site? NOTHING, NOWHERE! Forum rules do not, nor would apply to the multi-player aspect of the game.
That and EULA is usually, as you can read, is just a bunch of legal, copyright junk. And I have not read any Terms of Service, or anything in regards to the multi-player aspect of the game.

THE SOFTWARE IS PROVIDED "AS-IS". NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON. Step 1: Games WILL PROVIDE NO REMEDY FOR INDIRECT, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES ARISING FROM IT, INCLUDING SUCH FROM NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR CONTRACT, EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.
5. Term.
The term of this license grant is perpetual. You may terminate this Agreement at any time by destroying all copies of the Software in your possession. Your license to use the Software will automatically terminate if you breach the terms of this Agreement.
6. General Provisions.
This Agreement is the sole and entire Agreement relating to the Software, and supercedes all prior understandings, agreements, and documentation relating to the Software. If any provision in this Agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions will continue in full force without being impaired or invalidated in any way. This Agreement will be governed by the laws of the State of Oregon, without regard for its conflict of laws principles. With respect to every matter arising under this Agreement, you consent to the exclusive jurisdiction and venue of the state and federal courts sitting in Lane County, Oregon. This Agreement does not create any agency or partner relationship. Your rights under this Agreement are personal and do not include any right to sublicense the Software. Step 1: Games reserves the right to ban you from playing Blockland online at any time for any reason and without notice.

You do realize Kaphix only said that to Jsk because he wanted to feel like he won. My 3 year old cousin does this...

Race is not just about "skin color". It can be based upon a number of identifying factors...including #'s themselves.
ID owners below 1000 seem to express the tribal view that those of an ID number above 1000 are inferior to them.
However our choice of diction is beside the point.
What I think should be made clear, however, is that Badspot said he would ban the offending servers if they became a problem. (IE. many servers with same descriminatory policies). Your argument that "one server doesnt matter" is not relevant to what BS said and what I supported. We're talking about large numbers of servers, at a prohibitive level severeing the playerbase.
Just as Steam has the VAC system to help safeguard servers, BS should have the same priveleges in regards to protecting the interests of himself and his customers.

I'll let you call it being tribal on Kaphix banning those over 1000+, but only if it makes you happy.
Always, with that aside, I'm still curious on what Badspot has to say, or someone educated enough can respond to my original question in regards to the legality of being able to ban a server from advertising.
