Would you consider this spawn killing?

So this guy sits outside the opposing team's base waiting for people to come out. When they do, he shoots and kills them. Would you call this spawnkilling? The person denies that it is spawnkilling and complained for 15 minutes of his 20 minute ban after multiple warnings. Thank you for your input!

If the players have their guns out and are able to get a shot at him, I wouldn't consider it spawn killing.

He had over 500 points in Kong's server and had all of the best weapons.
