Normally you can't get into the enemy's tanks, but the gamemode was broken and people were getting into them.

If the driver is on your team, you can't hurt the vehicle. If the driver is an enemy or no one is driving, you can hurt the vehicle. It has nothing to do with which team owns the vehicle.
