legally it counts as income
you could get it taken away because of tax fraud if you dont
unless you legally sign up your server as non-profit

I doubt it. Badspot hasn't specifically said that no one but him can gain money from server donations/server hosting, so technically it would seem to be just as if a friend you know gave you $5 for being a good friend.

Where exactly does it say that the money goes directly to RTB hosting?

It still counts as income, though, and it's tax fraud if you don't report it. PayPal tells the IRS that they paid you a certain amount, and the IRS expects you to report that you received that amount.
