if he does something so bad as in ruining the game for others and banning people for no reason then he should be banned as well
personally i wouldn't want someone who does that stuff on my server
at the same time though you could argue that since he's not in the power to do so then it won't happen
even if you wanted to punish him you could ban him for a week or so but perma??
i'm pretty light on banning though so it might just be me
