In hindsight, probably not. You want to know what the shooter didn't have? Hindsight of his current situation. This is why police officers don't lose their jobs when they shoot somebody who looks like they're pulling a gun when they're not, and this is why this case could very well be ruled as self defense.

In the OP there's a single clip of the 'victim' getting between two people pushing each other which apparently is enough to confidently affirm that he is incapable of violence

As well as he already pepper sprayed to attempt to get them back, so there probably was a likely chance that the guy rushing towards him probably had a weapon.
