Under that logic, all the Jews massacred in national socialist Germany were not innocent civilians but rather guilty criminals.
Violating the law doesn't make you evil or in the wrong. Laws are wrong sometimes.
Perhaps the referendum may have violated the Spanish Constitution (I'm not a lawyer, and especially not a Spanish one, so I can't offer an opinion on that). But what I can offer an opinion on is the fact that constitutions should protect the people from the government, not the other way around. And even if you oppose the referendum (which is reasonable), I hope for your sake that you don't support the Spanish government's actions.
