Author Topic: apparently the blockland trademark is dead and can be bought?  (Read 3352 times)

Whoever buys it should give it to the guys making the Blockland-inspired game.

basically

if badspot stopped selling the game then you could use it for another game
but otherwise, it would be in your best interests to not use it for anything that could cause any confusion

This is probably the best snippest that applies in this case

Just because a mark is listed as “dead” at the USPTO, does not mean it is available to use without registration, or to register.  It’s possible that the registrant of the trademark abandoned the federal trademark registration, but is still using the mark – and so still has common law trademark rights.

I think the same thing applies here with what happened to Exploding Kittens, which got big but didn't trademark it. If Badspot really did give a forget he could get the rights back if he can prove legibility that it's his.

Then again, assuming Badspot did cancel it himself, not sure about that scenario.

I mean, I guess he's alive, but other than that...

...should this count as another "blockland is dead" thread?

...should this count as another "blockland is dead" thread?
i mean he did use the word dead assuming he meant the ownership could be lost, but I wouldn't go far as to saying the game is exactly dying.
who knows, a new dev could do something productive 🤔

sigh guess we're adding blockland's own trademark to the list..

oh stuff
one day after this
