It's not self defense or legal. He's going to be sued.

You can't legally self defend against a baton in Portland because batons are not deadly force in portland. Anyone who thinks otherwise is literally ignoring an actual law and is entirely deluded

I didn't write Portland's legal code forgeter. I have literally no opinion on what he should or shouldn't have done. All I know is that he's 100% getting sued for the amount of damage he caused to that antifa guy, unless they randomly decide not to press charges

This is highly unlikely because again it still wasn't legally self defense. In the end he did punch someone and gave them brain damage, since it's not legally self defense he'll be sued in order to pay for the guys medical bills

There was a case where to boys were fistfighting each other and one guy killed the other guy by accident with one punch and the guy that did it was sued up the ass by their family and lost the lawsuit. This stuff happens all the time

The USE of deadly force is prohibited. Meaning you cannot use a gun on a guy with a baton. But the man is allowed to defend himself against a baton as long as he is not using a weapon himself.

This guy hit the man with ONE punch, he did not hit him with multiple punches. it was clear that he did not intend to use deadly force.

It's not his fault the antifa guy is drinking nothing but soy to the point where he would become brain dead with 1 punch.

If you see Mike Tyson down the street and you have twig arms do you think your baton is going to do anything to him?

Neither of them really commit a real crime in the end. The antifa guy almost commit battery but that changed when the  right guy fought back. After that both people were committing misdemeanor assault and at this point either one of them can file a lawsuit

that is how it works. You can ONLY defend yourself against any attack that involves deadly force in Oregon. What you posted is a subsection of the defense law, but the primary law of self defense is pretty clear

A baton is not deadly force, therefore you cannot self defend against a baton attack unless they are actively causing near fatal damage. The antifa guy barely got a hit at all with his baton

personally they were both in the wrong imo. you dont just loving whack someone on the street in the name of "forget FASCISTS!!! national socialist!!!" but you also shouldnt literally punch someone so hard that they get brain damage
