Don't even buy from them, they take it out of the plastic, in my opinion that would make it "used".

Yes. This makes sense.
Most of these game retailers now days won't put up with the "I don't like it, give me my money back" excuse.
I suggest you go in a on a different day and give them this reason instead.
"The game has a compatibility issue on my console."
Claim you own a console from a different country. Etc.
Ive had to do that twice to them.
