Paradox Topic

this isnt much of a paradox but:
a man will be sent to jail, the judge saysesays, "give me a false statment and you will be sentenced to 6 years in prison,give me a true statment and you will be sentenced to 4 years in prison". But the criminal is let go, how?

sry, forgot to mention, he never spent years in prison. he was let go. BUT WHY?!?!?!
