Use Nvidia's Shadowplay if you can, its free and can be used for anything. But the catch is that only GTX 600+ cards can use it.

but even if i do make money off of it, do they actually have a way of telling which license i use based on seeing my youtube videos?
most likely. did you know that what you're asking us is whether or not you can break the law?

erm i guess i just wont make money off of it, but dealing with the slow laptop that i use has really gone to my head and i just wanted to get a new pc asap

what were you trying to record?? and how on earth were you planning to get enough people to watch your videos to pay for an entire computer?

i dont know i actually just thought it would help. although i didnt have any sort of plan.

my files take up less space than fraps, fraps dropped my fps drastically while action doesn't, obs' quality is not nearly as good and also dropped my fps more

i can play diablo with about 50 fps in action, fraps/obs actually drop it to like 20

Planning on getting a computer upgrade at some point soon and definitely want something nvidia.

Yeah I didn't even think about that
But we don't know if OP has an Nvidia 600+ card
Yeah, shadowplay runs directly off the gpu, it has a negligable (a couple FPS), if any, affect on performance
It's still in beta tho and has fairly limited features, and last time I used it, it only worked with full screen games. Seems really promising though

manually record stuff for as long as you want
or... I'll just copy and paste what Nvidia says about "shadow mode"
"ShadowPlay records up to the last 20 minutes of your gameplay. Just pulled off an amazing stunt? Hit a hotkey and the game video will be saved to disk. Or, use the manual mode to capture video for as long as you like."
