i have noticed quite a few things from the torque engine demo that are extremely similar to stuff in AoT and basically lays out that all the material in AoT is his and basically copyrighted by him.

So the question is: Did badspot make both the torque demo and Aot or is he in a mess of copyright stuff even if its all free

Kork the orc is from tge too. Everything in tge is free to use if you brought it.

I paid for a TGE license, I am allowed to use the resources it provides.

The orc and knight models come with the Torque Engine, they are included specifically for you to use in your Torque project. 
The horse is a free resource from gamebeavers, though I had to re-rig it.
The skybox and textures are from various free/public domain online sources.
I also used some resources from GG like guiObjectView, dayNight cycles, and the grass replicator.  Most of them required fixes and had to be adapted for my purposes but they were a big help.

My contributions include but are not limited to:
The player model.
All weapon models.
All item models.
Port town, dungeon, forest, tavern, fort bad and cave interiors
All GUIs
Clothing code (dynamic texturing, color shifting, mesh hiding)
Grappling hook code
Dialog system
Mail system
Character saving system
Police/Crime system
Carrying people/resurrection
Store/shop system
Inventory system
Crafting system
Auto-updater
Monster and item spawning code
All the other gameplay stuff
And making a bunch of stuff that is included in TGE and is supposed to work, actually work.
