I think it is ok if you dont make any money off of it, but companies legally have the right to take the video off for copyright.
I don't think just saying it could get you banned.
I'm pretty sure it happened before. It was worded in almost the same way, and they got banned.

Without looking it up, you're legally allowed to use (I believe) 30 seconds of any song published over a year ago.

If it was illegal then youtube would've removed the sound. They've done it before. A lot. Why wouldn't they remove it from this video?

youtube doesnt do anything until someone files a copyright complaint
sega's lawyers probably dont scan all of youtube every day of the week to bring them down. to some extent they dont care


in a nutshell, you can't legally do it but you're not going to jail if you do it
you'll just get audio removed from your video if sega lawyers ever see it

youtube is making money off the video, so they're able to pay off the money for the music. i'm going to assume you won't have as many views, so they're aren't making enough money to cover the costs, so instead of losing money they'll just mute the sound.

Oh yeah, I remember that. I'm pretty sure you can do that legally.

Also I'm pretty sure Youtube scans the soundwaves or something, and if the companies have that kind of thing set up the companies are notified immediately.

Unless the copywrite is expired, it's still illegal.

If the artist is still alive, then it has a withstanding copyright.

If the artist is dead, you can use it.  Record companies legally can't take action on behalf of an artist that isn't able to represent themselves willingly.

In your case, stick to the 30 seconds.

I garuntee sega doesn't give a stuff about sonic adventure 2. If they did they would probably re-release it for the wii-u, 3DS, and really everything else in 3-d and make a ton of money from it.
