I would kill him. If the point of a DM is to kill people, why not kill someone because they are nice? That kills the entire point of the DM.

i get rather high killstreaks and Cucumber's when i'm not lagging like ass

people kill me regularly on my server and generally people don't complain about lag (excluding space guy, kalphiter, and anyone else who happens to get slaughtered on a regular basis)

If so, I remember that. He hated it due to the no killing builders rule and just ran around raging with a minigun.
