Why do we even need ACTA? All we need to do is have undercover officers finding people admitting they pirated music and then use it all against them in court. I mean people are usually pretty open about when they pirate music.

First of all, you can't use voice recordings or hearsay in court, second, the enforcement of anti-pirating laws often falls on the recording companies, which can not handle the issue.

Not really. Most money from itunes sales and whatever go to the labels. The artists make most of their money from merchandise sales and concert tickets.
