1. Yes, it does.
Any dismissive post gets the user banned.
Saying "I don't care" does not matter as long the whole post is not dismissive.
2. No, Badspot has never mentioned this before, therefore, he cannot ban people fairly for it until he announces it himself that it's bannable.
