Jailbreaking is completely legal thanks to a DMCA exception, and piracy is not what jailbreaking is meant for and is frowned upon in the jailbreaking/rooting community. It's not meant to get anything for free, it's meant to make your device customizable and your own, compared to just a normal looking device out there. The only way you can end up making jailbreaking illegal is if you install one of the applications that is deliberately meant to be used for piracy from a source that you can't get on a default jailbreak, so on that note:

You could try doing it in Linux. I find doing most of the stuff that involves the bootloader on my Droid 2 Global works better in Linux than it does on Windows.

Don't use ROM manager then, it won't work. The D2/D2G both have locked down bootloaders. Because of this, CyanogenMod is still a work-in-progress and isn't recommended for daily use.

First off, back up everything you need. Contacts, apps, all that.

What you're going to want to do is download the Droid 2 Bootstrapper and install it to your device, download any ROM for the D2 from this website, CyanogenMod is listed here too, put it on the sdcard of your phone. Then, open Droid 2 Bootstrapper and hit "Bootstrap Recovery" and "Reboot Recovery".

You'll be in ClockworkMod now, so navigate (using the volume buttons to move, camera button to go forward and the power button to go backward) to "Wipe Data/Factory Reset", after that gets done then navigate to "install zip from sdcard", hit "choose zip from sdcard", find the ZIP file for the ROM you downloaded onto your sdcard and choose it, select "yes" out of all the "no"'s, then let it do it's work. Once it's done, reboot your phone (hit power until you get to the main menu, then there should be a reboot option there).

Note, if you do install CyanogenMod, don't install Droid 2 Bootstrapper. If you need to get into ClockworkMod, hold down Power, go to "Restart" and you should see "Reboot Recovery".

I'm thinking about downgrading to iOS 3.1.2 (blackra1n jailbreak) from iOS 4.2.1 (greenpois0n jailbreak), but I don't really know if it'd be better.
I do use the iOS4 multitasking, but only for a certain few apps (Grooveshark, Pandora, some system apps etc., no games), but I'm pretty sure Backgrounder + SBSettings would work fine as a replacement.
I don't use the Game Center, or pretty much anything else that was new in iOS4.
I do use Winterboard; some themes actually still have issues in iOS4.

Would there be any noticeable performance increases?
Does it require a restore? (if it all possible I do not want to restore)

I dunno if I should though. Using an iPod Touch 2G MC model.
(I would wait for iOS5, but both the MB and MC 2G models aren't supported, it seems)

Unless you have your SHSH key for 3.1.2 backed up, you can't downgrade.
