And also swearing in public or a place where people can generally hear you is illegal in Alabama, I'm not sure if there are any national laws against it.

I'm sure when the Bill of Rights was written, "freedom of speech" wasn't added with the idea of people being able to swear and insult everyone. I'm sure it means more that you can express ideas freely.

He can tell you to shut up and although cursing isn't illegal he can arrest you for illegal things related to the swearing, like disturbing the peace or if it's really bad inciting a riot.

First Amendment protects your freedom of speech, but a cop can arrest you for disturbing the peace if you're running around spewing stuff and having a seizure.

People have the right to express any idea they want.

Doesn't mean people have to like it, no, it just means they have the right to.

However, that doesn't mean you can go around spewing obscenities just because you can. That's public obscenity if you're in public or something, which, believe it or not, you can get in trouble for.

You have the right to think the cop is a cigarette, you don't have the right to call the cop a cigarette in public. That's as simple as it gets. You can even write a book about how the cop is a cigarette and you can even write an internet blog about how the cop is a cigarette and if someone asks you what you think of the cop you can say he is a cigarette but if you are in public and call him a cigarette then you have the potential to incite others to violence so you get arrested.

In public, that's pretty much right.

If you are just shouting forget forget forgetidy forget forget running around in a mall or something yes.

They can say "You have the right to remain silent," but they can't say, "Shut up," I don't think.

I assume not.


I mean wowee, the guy just said one swear. All he would tell you is like "hey, watch your language, guy."

Anything more would probably be an abuse of power in my opinion. For instance, if you said that and he just whipped out his baton and started bashing your ribcage in and kicking your body and then beating your head in would be a step too far.
