these links, are your non conspicuous looking file names.
like funwithfriends.zip or gameindevelopmentprivate.zip
they contain the piracy that lies inside, while tricking the system.
of course the contents have legit looking file names too, but it's all the same thing: the pirated program you came to download.

of course, we need to boycott the torrent system for this tactic.

it's not as if your ISP is going to put you on some blacklist or beat down your door for downloading something.

i seriously doubt they will actively monitor the downloads of every customer they have. if anything, they'll just have a list of known sites dedicated to piracy.

that's what would make sense to me, at least.
