night fox and i were talking and then we ended up confused by this situation:
if someone who's underaged rapes someone who is 18+, who is the rapist?

statutory rape for 18+
plsnoidontwanna rape for underage



i wouldn't even call that rape

just weird underage love, lol

Both people are, I believe. But that's dumb, so I'd say only the under-age person should be considered a rapist in that scenario.

but let's say a 16-year-old guy forcefully (possibly violently, depending on resistance) has love with (rapes) a 19-year-old female, who did not wish to have love with, or even know, the guy

my friend was talking to his mom on the phone during a Skype call and it escalated to me discussing this same issue of if i raped his mom if i would go to jail. i think it's a double charge, but a jury would probably decide on charging me with rape and the rape victim would go free.

so I think if it's actual rape then the rapist gets the legal repercussions

Well no matter what it *shouldn't bounce off against the 19-year Old.

If proper evidence is given, then the 16-year old should be hit.
