and condoms don't ALWAYS work.
neither do birth control pills.
all forms of birth control have a really slight chance of failing
different situation, punish them harder

just because it doesn't work for some doesn't mean it works for all
Back in the day Rapists had a choice of death or sterilzation, then people protested and they just got sterilized. Then more people protested now they get prison time, a slap on the hand, and when they get out there are hardly any employers that will take them in so they go back to doing crime because thats the only way they can make a living.
