there IS background checks already. pretty thorough ones actually.
gun shows? private sales?

gun shows? private sales?
private sales are protected by the constitution.

and gun shows DO require background checks. they always require you to seek out an ffl dealer when you try to pick one up. or they are one already.

also, allllll the guns from all these recent shootings were bought from retail stores. with background checks...
and they were all legal legit owners.
you cant really stop people from stealing a gun from another person though. there isnt really a check to that.

gun shows? private sales?
I think its up to the dealer whether or not he will conduct sales according to background.

gun shows? private sales?
Yes at gun shows. And how do you expect a random person selling a shotgun to do a background check?

private sales are protected by the constitution.
Congress has the power to regulate all commerce.

Congress has the power to regulate all commerce.
Congress can't do stuff if the it is unconstitutional.

Congress can't do stuff if the it is unconstitutional.
Congress is given the power to regulate all commerce in article 1 of the Constitution.

Congress has the power to regulate all commerce.
No they can only regulate commerce between states, Native American tribes, and foreign nations. I don't think they are going to enforce commerce laws on someone selling stuff from their garage.

Not between states, among states. The commerce clause has been used many times in this way and has been expanded to literally every form of commerce.

Well guess what, private sales still happen unregulated or not. And primarily unregulated.

It's called Interstate commerce for a reason.

Yes, they are primarily unregulated, I am not saying they aren't. I just said that Congress has the power to regulate them.

Democrats are whiney and pouty too.

Also good, finally left wing morons are put in there place for the time being. You can't win them all.
left wing morons? lol you think right wing ones are any better?

yeah anything taxable can be regulated.

lets see them try to enforce that on private sales lol. that is literally impossible. the legal loopholes are endless.
i could GIVE my gun to someone and its not commerce.

though you cant legally give a serial-numbers retail gun you bought.
but otherwise the other billion guns are free trade.

left wing morons? lol you think right wing ones are any better?
The right wingers are huge ass pussies. They got great ideas but they aren't as aggressive as they use to be. Left Wings are acting like idiots as usual and have successfully broken up stable systems and caused as much bullstuff as possible.

Reading the Constitution at face value isn't the best strategy. The commerce clause has been expanded a ton over the years, and was actually pulled back down to only include:

matters of trade (whether interstate or not) and production (whether commercial or not).
