Seriously, if someone comes in your server and says "you fail" or something and you make a topic requesting a ban on them, you're only proving their point.

I agree, I can't stand when people ask for a ban for the stupidest damn things on the planet.

The only thing I would say something about but not request a ban is if they are breaking their terms of service.
