Solution to OP's problem: Open the box at the store.
I've bought a couple preowned games from Gamestop that had badly scratched/broken discs and they were pretty cool about replacing them as long as I had the receipt and I didn't wait a week before telling them. And if you actually bought a new copy of Black Ops and it didn't come with a First Strike key you should take it up with Activision.
