They should make it a felony offense like drunk driver if the driver injuries someone while texting and driving. A misdemeanor offense if no one is hurt, but the driver is caught texting.

Reckless Driving should be Reckless Driving, there shouldn't be intensifiers just because something isn't politically correct or because of what it caused. I could be just as distracted finding my favorite CD. And whatever it caused should be a seperate charge.

If you separate the fact that the lady was texting and the fact that he was trying to cross a highway, then you can see that both were at fault. there's a missing piece here as to why he stepped into the middle of a highway.

the driver is certainly at fault for texting and not stopping, but there is literally 0 reason to j-walk into the middle of a busy highway and expect not to be hit.
