UPDATE: Step Dad is accused of loveual assault

Ever since the allegation, my step dad has been unable to be at the house, and therefore he lost his job, leaving my mom and him with not enough money to get their names on the house. So we have to move.

Now, we're seriously sure that my sister was lying about the allegation for attention. My mom believes it started when my mom said that if my sister's boyfriend ever had love with her, it would be statutory rape and my mom would go the police, and this of course, upset her boyfriend.

My sister probably made it up, but never meant for it to go to the police, and she told her boyfriend, whose family blew up about it, and made her go to the police. I, the closest witness, was awake during the time it (supposedly) happened, and I heard nothing going on. There's also no other evidence to go by except for my sister's word.

My sister's story that she told the police:
She claims that he burst into her room, and started to loveually assault her. She fought her way out of her room, and she tried to get to the kitchen, to grab a knife and defend herself, but he stopped her.

THINGS WRONG WITH THIS STORY:
Me, being a night owl, would have been awake during the acclaimed time of these events. I am almost always on my computer, but when I'm not playing video games, I have my headphones off. Seeing as this stuff would have been VERY NOISY, I would have likely heard it, with my room being across the hall. Additionally, this all happened during the time my step dad gets ready for work. That morning, he came and checked up on me when he came out of his room. I heard the usual noises of him getting ready for work, (shower running, fridge opening, front door opening, etc.) but nothing that even mildly sounded like anything happening in my sister's story.

Anyways, my sister is now going off to live with our dad, leaving my mother emotionally crushed, my half-brother (who my step dad is technically his now adoptive dad.) with a deep hate for her, and me being crushed in the middle of all of this. And after my half-brother moves out, (He turns 19 at the end of August) my mom and I will be left all alone, unless my step dad is not charged for this.

I'm scared by the fact of all the stories I hear about of innocent men's lives being ruined due to false claims of rape, even though they don't have any evidence backing them up.

I don't know what the forget is happening in these two threads, but customarily if someone accuses someone else of rape the police will do a rape kit to swab for stuff. If this wasn't done and if there is basically no evidence against him, no police department is going to believe her, especially with a third-party witness to testify that he heard nothing going on.

No, you're loving insane. If there is no evidence, none at all, police cannot prosecute any case. You're thinking about cases where consensual love occurs, but the woman claims rape, which is a definite he-said-she-said case if the only evidence is the fact there was intercourse.

In this case, if they found no semen from Op's step-dad, they had no case.

Edit: And this is all if he's suspected of raping her, I suppose loveual assault includes non-intercourse as-well.
