Not really, it makes sense and it's simple to follow.
The Embryo is the seed and the plant/sprout is a human.
If you take away the seed/embryo, you're not killing the plant/human because it wasn't there to begin with, so how could you kill it?

a seed has already been through a fertilization period with the mother and is in fact a plant...
