I think it's actually really rare that someone gets banned for flaming, and in this case it's not even flaming.

As I understand, the post would literally have to be responding to someone in a thread with just "you're stupid" or thereabouts, and nothing else. Which makes sense, and is of course not the case here.

badspot defines flaming as making a post with the subject of calling somebody handicapped. that doesn't apply to my post so thus im not flaming anybody
