It's not in my opinion.  If it was regarded as flaming, therefore rule breaking, they'd be banned.  It's a pretty simple rule of thumb to follow: If they're not banned, then they're not flaming, right?

Referring to them as flaming implies they're breaking a rule and need to be banned, you could have been a little more clear and said "I think they're flaming in a sense, but they don't need to be banned for it".  It was even more confusing once you referred to you getting banned for flaming, implying even more you think they should be banned/will get banned.  What was the point of even pointing out they're calling people idiots if you don't think they're breaking rules?  It was clear from the start they called someone an idiot.
