honestly the American political system balances power by basically allowing people to stop other things happening
so the President has the power to stop Congress doing stuff but can't make them do things (aside from dubiously-constitutional executive orders, which Obama seems to be a fan of)

Guantanamo Bay does not, itself, detain suspected terrorists. They're detained by the military and sent there. National security doesn't suffer in the slightest by giving suspected terrorists the habeas corpus and right to a fair trial that our justice system requires...
