Yes but only in situations where there is solid, tangible evidence that proves the person being charged with the death penalty has severely hurt or killed one or more people. Everyone should have the right to live but of they try to take that same right from anyone else, why should they get to keep it? They don't deserve it after that point, unless it were somehow accidental or it were a self defense situation, but even then, if that self defense is unnecessary, it should be considered depending on the situation.
