The legal system has been molded against people of color for the last 100 years and still is to some extent. There are cases of people sitting in jail for up to 3 years for the pettiest of crimes that they probably didn't commit and then being denied the right to vote afterwards or losing their job. There's never been a case of 'there are more black criminals than white' because all data supporting this statement has been concluded from an environment where black people were arrested significantly more.
Imagine if I had two sets of 100 red and 100 blue cups all flipped over. An unspecified amount of cups have a marble underneath. If you were to flip over 50 red cups and 50 blue cups and find that there are more red cups with marbles underneath, you just collected unbiased conclusive data.
If you were to flip over 80 blue cups and 20 red cups and find that there are more blue cups with marbles, you just concluded something possibly entirely false and did it using biased means. This is how the profiling system has been set up & supported for the last 100 or so years
