I think the point is that it may not be LEGALLY considered theft.
But it's morally considered theft, to most.

Just mail it back, it would be far less of a headache anyway.

you dont notice, and 2 days later the cops show up at your door for theft

yeah, no, theft is intentional and perpetrated by the robber, not by the victim as a mistake. it doesnt take a genius to look up and understand the definition of theft. he should send the card back and not be an starfish, but its most definitely not theft.
