Since Lego's copy-rights are now over(to a certain extent), mega-blocks has announced plans to release simular blocks to lego.
so why doesnt blockland go ahead and go retail without legos permission, since it seems it is no longer needed. the minifig and their block designs' are now open for others to use.

The court case is over the functional features of the interlocking studs, not the minifig.
