No, I'm pretty sure it modifys the search results, so sponsors that pay get links on top
So its totally legal. (if you don't mind messed up search results)

I'm trying it now, and it's pretty crap. I've been searching random stuff for the past 5 minutes and I only got some of these "swag bucks" twice. I have 5. Considering most good stuff is around 1000 or so, no thanks.

EDIT: Apparently, certain searches are tagged to give you swag bucks at random, and the first person to search that gets them. Still sucks.
